Construction Law
Each year thousands of construction workers are injured or killed in construction site accidents. Although construction companies are required under the law to inspect each site with safety engineers and implement a wide variety of safety measures, construction workers face a greater risk of work-related injury or fatality than employees in any other U.S. industry. New York laws recognize the inherent risks of construction work and provide protection to construction workers involved in work site related accidents.

A construction worker involved in a work related accident in addition to a workers' compensation claim may have a third party law suit against the general contractor and/or owner of the construction site pursuant to Sections 200, 240 and 241(6) of the New York Labor Law.

Section 200 of the New York State Labor Law codifies a common law obligation of reasonable care in the maintenance of the work site. Labor Law Section 240, also known as the "Scaffold Law" makes both the owner of the property and the contractor on site strictly liable for workers injured as a result of inadequate or missing safety equipment at elevated work sites. Section 241(6) of the New York State Labor Law imposes a duty upon the general contractor and/or owner to comply with all provisions of the New York State Industrial Code. Architects, subcontractors and manufacturers of equipment may also be held responsible for inadequate safety provisions. Call us today at 1-888-518-INJURY or Click Here to contact us.

Wrongful Death
When a person dies because of someone else's failure to use ordinary care or negligence, his or her survivors have a wrongful death claim against the person or entity at fault. New York State strictly limits the types of damages recoverable in wrongful death cases. Thus, careful attention is paid by our New York wrongful death attorneys when proving recoverable losses. These recoverable damages include pre-death conscious pain and suffering and "economic" damages. Economic damages are not limited to actual financial loss. For example, a child's loss of parental moral, intellectual, physical training and guidance is deemed to have an economic value. If your loved one died from someone else's fault, please contact one of New York wrongful death attorneys at 1-888-518-INJURY or Click Here to contact us.

Dog Bites
Dog owners are responsible for ensuring that their pets do not cause harm to others. When a dog attacks a person, the resultant injuries can sometimes be severe, requiring emergency and ongoing medical treatment. Scars and disfigurement can occur in serious cases, and in the worst scenarios, victims may be killed. Children are often bitten by dogs after unknowingly provoking them. In most cases, the dog owner's homeowner's insurance handles injury claims. If an attack happens while the victim is legally on private property (e.g. an invited guest, to deliver mail, etc.) or while the victim is on public property, the owner is typically liable as long as the victim was not intentionally and persistently antagonizing the animal. If you or a loved one has been the victim of a dog bite, please contact us today at 1-888-518-INJURY or Click Here to contact us.

Semi-truck Crashes
Semi-trucks often pose inherently dangerous driving conditions for other vehicle drivers. Semi-truck drivers often must navigate at speeds slower than the flow of traffic-with large blind spots and their trucks are prone to jack-knifing because of their awkwardly distributed weight and higher center of gravity. In addition, trucks may spill their loads, potentially causing accidents and injuries to other drivers on the road. If you or a loved one has been injured in a semi-truck accident, please contact our office at 1-888-518-INJURY or Click Here to contact us.

Defective Products
Thousands of people are seriously injured or killed every year by dangerous and defective products. Many of these injuries could have been avoided if appropriate safety and design measures were taken to ensure the quality of these products. A defective product may include dangerous toys, industrial machinery and equipment, improperly designed consumer products, automobiles and prescription drugs. When someone has been injured while using a product, even if human error is partially to blame, they may still be entitled to be compensated for their injuries. For example, a manufacturer must take into consideration normal human error. If an appliance or machine was not designed to function safely in the event of human error, the manufacturer may be found negligent. If the product was not labeled with sufficient instructions or warnings about necessary precautions because the manufacturer failed to do so, they may be found to be at fault. The law protects consumers and workers from these types of products by permitting them to sue manufacturers or other entities responsible for the defective machinery or appliance and recover monetary damages for their injuries.
